Please read these terms and conditions of use carefully before using our medical tourism platform services.
PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY. BY ACCESSING OR USING THIS WEBSITE, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS WEBSITE.
1. Agreement and Definitions
These Terms & Conditions ("Terms") are between you and HealMinded, trading as HealMinded ("HealMinded"), in respect of the website located at https://www.healminded.co.uk (the "Site"). These Terms govern your access to and use of HealMinded's services and websites (collectively, the "Services"), and any health or related data uploaded, downloaded, transmitted or otherwise appearing on the Services (collectively, the "Data").
HealMinded provides an online marketplace/appointment platform that allows users to locate and make appointments with independent medical service providers, including hospitals and clinics (each a "Provider"). HealMinded is not a healthcare provider and does not itself provide medical services. Information on the Site (including information from Providers or third parties) does not constitute medical advice, diagnosis, treatment or a substitute for in-person clinical consultation. Decisions to start, continue or cease any treatment should be made with a qualified clinician.
HealMinded may display and rank Providers via an automated algorithm using objective criteria obtained from users and Providers. HealMinded does not assign a specific Provider; it presents a list based on the criteria you provide. If you book an appointment, you acknowledge you are entering into a direct contractual relationship with the Provider, and that HealMinded has no responsibility or liability for services provided by the Provider or for the acts/omissions of any Provider. HealMinded does not recommend or endorse Providers and gives no warranties as to Provider information, which remains the Provider's responsibility.
2. Reviews & Publishing Rules
You may leave reviews/feedback relating to your medical journey and Provider experience. Only the patient (or lawful representative) may submit feedback. Reviews may affect Provider ranking. By submitting content, you agree to the following rules (non-exhaustive):
- • Do not publish personal data (yours or others').
- • Do not publish detailed medical records or confidential Service details.
- • No profanity, hate speech, discriminatory remarks, threats, sexually explicit content, violence, or promotion of illegal activity.
- • No promotional/advertising content.
- • No political, ethical or religious commentary.
HealMinded may remove or moderate content that breaches these rules or applicable law.
3. No Medical Practice
HealMinded does not provide medical services. Information on the Site (including Provider/third-party information) cannot replace a medical examination and must not be used to independently decide whether to commence or terminate treatment.
4. Provider Listings
HealMinded provides information about Providers based on your needs (availability, geography, medical needs, etc.). Allocation is not performed; instead a list is presented (e.g., name, address, specialisation) and you may choose and book.
5. Your Responsibilities & Eligibility
You are responsible for your use of the Services and any Data you submit/share/upload, and the consequences thereof. You may use the Services only if you can form a binding contract and are not barred under applicable laws. If using the Services on behalf of an entity, you warrant you are authorised to do so. You must comply with these Terms and all applicable laws and regulations (local, national and international).
6. Account Scope
You may not use a single account to provide outsourced customer service/support to multiple third parties (other than authorised affiliates) or contrary to any API policies communicated by HealMinded in writing.
7. Service Changes
The Services evolve and may change in form/nature without prior notice. HealMinded may suspend or discontinue the Services (in whole or part) or impose storage/use limits at any time.
8. Security
You are responsible for safeguarding your passwords/credentials and for all activities under your account. Use strong passwords. HealMinded is not liable for loss/damage arising from your failure to secure credentials.
9. Data Responsibility
All Data is the sole responsibility of the originator. HealMinded may, but is not obliged to, monitor or control Data submitted to the Services and cannot take responsibility for such Data. Use/reliance is at your own risk.
10. Rights in Data & Warranties
You are responsible for your Data and consequences thereof, including use by third parties. You represent/warrant you have all rights necessary to submit Data and to grant rights contemplated herein, and that your Data (and HealMinded's permitted use) does not infringe third-party rights or violate law (including privacy/publicity rights).
11. Connectivity
A high-speed internet connection is required. You are responsible for obtaining/maintaining connectivity and compatible browser software (e.g., TLS). HealMinded is not responsible for the reliability/security of networks not owned/controlled by HealMinded.
12. Compliance
You are responsible for ensuring your use of the Services and Data storage/transmission complies with applicable laws, regulations, and your own policies/agreements. You are responsible for determining the accuracy/sufficiency of outputs for your purposes.
13. Intellectual Property
The Services are protected by copyright, trademark and other laws. HealMinded reserves all rights not expressly granted. Any feedback you provide is voluntary and may be used by HealMinded without obligation.
14. Age Requirement
The Services are for individuals 18+. A user may lawfully act on behalf of a minor where they have appropriate authority and notify HealMinded where required.
15. Provider Information
Provider details are based on data supplied by Providers or sourced/curated from various sources. HealMinded uses reasonable skill and care but does not verify accuracy/completeness and is not responsible for errors, omissions, or non-delivery by Providers. Listings are not recommendations or endorsements.
16. Disclosures
HealMinded may access, preserve and disclose information where reasonably necessary to: (i) comply with law, regulation, legal process, or governmental request; (ii) enforce these Terms; (iii) detect/prevent/address fraud, security or technical issues; (iv) respond to support requests; or (v) protect the rights, property or safety of HealMinded, users or the public—in accordance with applicable UK data protection law and our Privacy Policy.
17. Prohibited Conduct
You agree not to, among other things:
- • Access non-public areas
- • Test vulnerabilities
- • Scrape or use non-approved interfaces
- • Forge headers
- • Interfere with users/networks
- • Circumvent protections
- • Deploy spiders/robots/crawlers
- • Send spam
- • Misuse trademarks/meta tags
- • Use the Services for unauthorised commercial purposes
- • Reverse engineer
- • Collect personal data without consent
- • Violate law
- • Encourage others to do so
18. Additional Use Restrictions
You agree not to:
- • License/sublicense/rent/lease or exploit the Services except as permitted
- • Process Data for third parties (other than authorised agents)
- • Hack or gain unauthorised access
- • Falsely imply affiliation
- • Violate privacy rights
- • Infringe IP
- • Degrade performance
- • Post unlawful/abusive content
- • Transmit malware
- • Otherwise breach these Terms
19. Repeat Infringers
HealMinded may terminate accounts of users who repeatedly infringe rights of others.
20. Payments & Cancellations
Please review the applicable Payments & Cancellation Policy before booking. Appointment details will not be shared with irrelevant third parties. You must notify HealMinded promptly of cancellations. Cancellation may apply where:
- • The Provider finds you ineligible for treatment
- • The Provider finds you ineligible to travel
- • Force majeure events
- • Death, provided services have not been rendered
21. Deposits, Rescheduling & Late Cancellation
Deposits are non-refundable. You may reschedule once within 12 months without charge if done ≥14 days prior to the appointment. Late cancellation or no-show may result in charging the full operation fee.
Cancellations must be made by completing and signing the Cancellation Request Form available at here and emailing it to finance@healminded.co.uk.
22. Pre-Operative Conduct
By using the Services, you confirm you will abstain from drugs/substances or alcohol for 2 weeks prior to surgery, acknowledging that breach may lead to cancellation without refund.
23. Revisions (Post-Op)
Where a revision is required for a surgery initially arranged via HealMinded, all costs of any revision belong to the doctor/clinic or the patient. HealMinded's role is limited to facilitating communication.
24. Term & Termination
You may terminate these Terms at any time by deactivating your account and ceasing use. HealMinded may suspend/terminate access at any time if it reasonably believes you have violated these Terms, created legal risk, or continuation is commercially unviable. Certain sections survive termination.
25. Relationship with Providers
HealMinded facilitates communications between users and Providers. If you and a Provider conclude a contract, HealMinded is not a party and has no rights or obligations under such contract.
26. Indemnity
You will indemnify HealMinded, its officers, directors, employees and agents against claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from: (i) your use of the Services or Data; (ii) your Data; or (iii) your breach of these Terms.
27. Treatment Plans
You acknowledge any initial plan based on information you provide may change following in-person clinical evaluation.
28. Important Liability Information
READ CAREFULLY:
Nothing in these Terms excludes or limits liability that cannot be excluded under UK law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Your statutory rights as a consumer (if applicable) are not affected. To the maximum extent permitted by law, the limitations below apply.
29. No Doctor–Patient Relationship with HealMinded
Use of the Site/Services does not create a doctor–patient relationship with HealMinded. Do not rely on statements by HealMinded personnel as medical advice.
30-36. Disclaimers & Limitations of Liability
The Services and all information are provided "as is" and "as available." HealMinded makes no warranties (express or implied) as to merchantability, fitness for a particular purpose, non-infringement, completeness, accuracy, availability, timeliness, security or reliability.
HealMinded is not liable for:
- • Harm to devices, data loss or other harm from accessing/using the Services
- • Deletion/failure to store/transmit Data
- • Whether the Services meet your requirements or are uninterrupted/secure/error-free
- • Third-party conduct or content
- • Unauthorised access/use/alteration of transmissions or Data
To the fullest extent permitted by law, HealMinded shall not be liable for indirect, incidental, special, consequential or punitive damages; or loss of profits, revenue, data, use, goodwill or other intangibles, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if advised of the possibility.
34. Third-Party Links
Links to third-party sites/resources are provided for convenience only. HealMinded is not responsible for their availability, accuracy, content or services, and no endorsement is implied. Use at your own risk.
37. Suspension for Cause/Force Majeure Events
HealMinded may temporarily suspend access for maintenance, for events beyond reasonable control (e.g., acts of God, government action, civil unrest, internet failures, DDoS), or if malicious software is suspected.
38. Governing Law
These Terms and any dispute or claim (including non-contractual disputes/claims) shall be governed by and construed in accordance with the laws of England and Wales.
39. Jurisdiction
You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter/formation (including non-contractual disputes/claims).
40. General
No failure or delay to enforce any term is a waiver. If any provision is invalid/unenforceable, it shall be limited to the minimum extent necessary, and the remainder remains in force. You may not assign these Terms without HealMinded's prior written consent; HealMinded may assign freely. These Terms bind and benefit permitted successors and assigns.
41. Notices
HealMinded may give notices via email or by posting within the Services. For email, receipt is deemed on transmission. Contact: info@healminded.co.uk (or as updated on the Site).
42. Entire Agreement
These Terms and the HealMinded Privacy Policy constitute the entire agreement between you and HealMinded regarding the Services (excluding any separate written agreement that expressly overrides these Terms).
43. Force Majeure
Neither party is liable for failure/delay to perform caused by events beyond reasonable control, including natural disasters, acts of civil/military authorities, pandemics/epidemics, civil conflict, war, strikes, fire, or similar events. If a force majeure event lasts over 30 days, either party may terminate these Terms or any appointment on notice.
44. Changes to Terms
HealMinded may revise these Terms from time to time. For material changes, HealMinded will notify you by email (to the address on file) or via the Services. If you do not agree to changes, you must cease using the Services. Continued use after changes take effect constitutes acceptance.
